The first step would be that a victim of some form of violence under the statute occurs. This meets the same standards for a protective order that we've discussed in prior videos. And if the police officer believes that this meets that statutory guideline, the police officer will help the victim of the crime to complete a petition for the protective order, if they so desire it. If you have reasonably suspected or known that child abuse is occurring for a period of six or more months, then it's a felony. If, however, you don't report and you've got reason to believe that there's suspected child abuse, up until that six month mark, is only a misdemeanor to knowing and willfully fail to make that report and it requires a prompt reporting. Now we all know what child abuse is. It's pretty obvious. And we all have a duty to report it if we witness any of it or believe or suspect that it's occurring. Child abuse is harm or threat of harm to the safety or wellbeing of a child. It includes non-accidental injury. It can include accidental injury, sexual abuse, and sexual exploitation. Sexual abuse includes rape, incest, or lewd, indecent proposals. Sexual exploitation includes allowing a child to engage in child prostitution or enabling them to engage in inappropriate sexual acts. Neglect means failure to provide food, housing, medical treatment, or anything the child might need or failure to protect them from some dangerous condition. Any report of child abuse or neglect perpetrated by an adult who is not the parent of the child will be automatically referred to local law enforcement for purposes of criminal investigation. Once the Oklahoma Department of Human Services is done with their investigation, they will issue a report. And those reports will have, line for line accounting for every interaction that those DHS investigators had during the course of that investigation. If the Oklahoma Department of Human Services believes that child abuse or neglect is substantiated, then they will refer it to the local district attorney's office for, either, criminal filing or the starting of deprived proceeding. Put simply, a deprived case involved a responsible person, a person responsible for the care and supervision of a child and the state alleging that that child is either abandoned, abused, or neglected. The scope of the court's view is the welfare of the child in the entire familial context. The court has a range of options and abilities through use of the Department of Human Services to offer rehabilitation and therapeutic services in order to prevent the termination of a parent-child relationship.
