The Answer Is Yes

Today, I want to answer one of them. “Can she have her new boyfriend sign my child’s birth certificate?” The answer is yes. Now, that doesn’t mean that you can’t get rights established nor that you can’t be determined to be the father in an administrative court. However, that presumptive document will require that you conduct a genetic test in order to rebut a presumption that you are not the father.
So the hospital is not going to question mom if a gentleman is present and signs the birth certificate. What that means is that you have to move quickly when you know that child is born to file in a district court or an administrative court in order to get a paternity test conducted using genetic or DNA analysis.
Under those circumstances, if you are the father, it’s likely that the court will find you to be the parent of that child, even though her boyfriend signed the birth certificate.
