Alimony Calculations
Hi, I’m Oklahoma fathers’ rights lawyer Heath Davis. One of the most common questions I receive is what does a court look at when calculating alimony? The short answer to that is there really is no method. The court is to use what we call a two-pronged test. That two-pronged test means A, does one party have a need and B, does the other party have a surplus in order to meet that need? The courts often determine this by looking at your budget.
Basically the court looks at what your monthly expenses are, what your monthly income is, and does one party have an excess or surplus of funds that they could use to meet the need of the other party. So it’s important to make sure that you’re keeping an up-to-date budget and up-to-date on what your bills are so that if you are going through this process we can easily calculate what that budget needs so we can use it for presentation to the court.
