The Investigation Element of the Guardian Ad Litem’s Job Is the Most Important

In modern practice, Guardian ad Litems are more or less used as a settlement tool and a way for people to get a prospective third-party neutral to sort of dig into the facts, make a position, and based on that sort of allow parties to understand more or less the strengths and weaknesses of their case should they go to a trial.
It’s also an application used in the more serious cases, particularly if maybe there are some allegations that are really of a serious nature that may or may not be credible, so if there’s, for instance, accusations of child sexual abuse but you don’t have a police report or DHS referral or other things like that, and it may be just a device used for purposes of the family litigation. People bring on Guardian ad Litems to defend themselves in ways too in preparation for those hearings.
But yet, the investigation element of the Guardian ad Litem’s job is probably the most important. And that is also going to be the basis for you to really attack their inevitable opinion or report.
