File a Motion to Enforce If Your Rights Have Already Been Established
Video Transcribed: Hi, I’m I am a child custody lawyer in Tulsa, OK. I am here to answer questions about fatherhood and father’s rights. Today I want to answer the question, what to do if your rights are violated?
There are several options for you if your rights are violated. My advice to you is to contact a lawyer immediately. Your lawyer will then probably tell you that you should file a motion to enforce if your rights have already been established, as well as file what’s called an application for contempt.
And an application for contempt is basically requesting the court issue a contempt citation saying that the other person is guilty of a misdemeanor. At which point, you’ll get a hearing within at least three weeks’ time on that motion to enforce.
And then sometime thereafter on the contempt citation. In most cases, if you stack this sort of pressure on the other side, they will give in, buckle and you will get your rights to your child. If somebody is violating your rights to your child you need to give us a call.
