Physical Custody Is the Time That You Spend With the Child and Your Entitlement to That Time
Video Transcribed: Hi. I’m a father’s rights lawyer in Tulsa. I’m here to talk to you a little bit about fatherhood and father’s rights. I want to talk a little bit about equal rights today and what that means.
Equal rights require that the court, the district court in the child’s residence, not only establish you as a father but afford you joint custody rights.
Custody rights are legal rights to decision-making authority over that child. In order for you to have equal rights to that child, you’ll be required to establish joint custody in a district court.
Otherwise, you will be under her thumb and subject to her sole custody rights. I want to make the distinguishment between custody rights and physical custody.
Physical custody is the time that you spend with the child and your entitlement to that time. Generally speaking, this could be referred to as visitation. However, legal custody requires a custody determination by the district court of the child’s residence.
