Equality in Custody Determinations
The answer is no. Long ago that used to be the case, but as rights for fathers have progressed, the court is to assume that both parties are fit and proper to have custody of the minor children. That means the court is to start at equal custody and equal time. And then if there are any issues with regards to one parent or the other, the court can start to move the pendulum in one direction or the other. So the answer is no.
Fair Assessment of Parental Fitness
