Visitation Determinations
Hi, I’m Heath Davis, a fathers’ rights attorney in Tulsa, Oklahoma. Another question that I receive is, what does the court look at in determining a visitation schedule? The court looks at what the overall best interest of the minor child are.
Visitation Schedule Options
If you are doing a 50-50 split on visitation, there are multiple ways in which that split can look. One is a week-on-week-off approach, another is what we call a 2-2-3 approach. What that means is one parent would have the child or children on Monday and Tuesday, the other parent would then have the children on Wednesday and Thursday, and then the parties would simply alternate the weekends. Another approach is what we call a 4-3 split.
What that means is one parent would have Sunday, Monday, Tuesday, Wednesday, the other parent would have Thursday, Friday, Saturday, and then that would alternate based on a weekly basis, which in essence is a 7-7 split or week-on-week-off approach. It’s just splitting the week down the middle, and really it’s in your best interest to determine what the best interest of your child is.
Collaborative Decision-Making
Basically, if you and your spouse can reach an agreement on the visitation schedule, that’s always the best approach rather than presenting it to a stranger in a black robe who doesn’t know your children and doesn’t know the dynamics of your family.
