Child Support Calculations
Hi, my name is Heath Davis, and I’m an attorney that advocates for fathers rights here in Tulsa, Oklahoma. One question that I’m asked is, if I am ordered to pay child support and my spouse gets remarried, am I able to use that new spouse’s income in order to lower my child support?
The answer to that question is no. In Oklahoma, when calculating child support, a court only looks up to the income of the mother and the father. A third party’s income is not allowed. However, if there are any prior born children or in-home children that come at a later date, that is a mechanism that can trigger a reduction in child support.
Factors Affecting Child Support
When determining child support obligations, courts primarily consider the income of both parents and the needs of the child. Other factors such as health insurance costs, childcare expenses, and visitation arrangements may also impact the calculation. However, the income of a new spouse is not factored into the equation.
Exploring Options for Child Support Modification
If you believe that your child support payments should be modified due to changes in circumstances, such as a new spouse’s income or additional children, it’s essential to seek legal guidance. An experienced attorney can assess your situation and help you explore your options for petitioning the court for a modification.
