Establish Clear and Simple Rules
Video Transcribed: My name is Jason Lile, and I am a Fathers Rights lawyer in Tulsa, Okla. I wanted to talk to you about what happens when you think that the other parent of your child or children should be supervised while they’re with them, or they’re accusing you of needing supervision while you’re with them.
Divorce lawyers and the courts call this supervised visitation for obvious reasons. There are two types. There is professionally supervised visitation, which is in the office of a counselor typically or some sort of professional supervisor.
You have to pay by the hour while they sit there and watch you be with your kid or kids. It’s exactly as it sounds. The other type is third-party supervision, where a family member or a friend supervises by the parties’ agreement or court order.
So why would you want somebody to be supervised? It typically has to do with the fact that there’s some pending fitness issue, meaning maybe they have a drug problem.
You’re waiting for them to get through rehab, or maybe they’re with a boyfriend or girlfriend that you think isn’t safe for the child or something like that, where the court and the party who’s asking for it thinks, “It would be better for now if that child weren’t alone with this parent, until we get through whatever hoops are decided or adjudicated that they need to go through to not have to have supervision with their child.”
The other thing is if you are being accused of something, where the other party demands or expects you to be supervised with your child or children. Then you need an experienced family law attorney to evaluate that claim with you and defend you against that claim because it is a tremendous burden not to be able to see your children without supervision.
Also, if you agree to the supervision, it has implications for your case down the road because it can and probably will be used against you that you once had to be supervised with your child or children. And if you agreed to it, you need to make sure that the lawyer defends you from the claim that you were admitting you needed supervision.
So it’s something you might have to deal with if there’s a fitness issue on either side by accusation or fact, and you should have an experienced family law attorney look at that matter for you.
