Parents Will Be Free to Establish the Terms That Work for the Family
Video Transcribed: My name is Jason Lile, and I am a Dads Rights lawyer in Tulsa. And one of the things that my clients deal with is legal pleadings. And when you read legal pleadings, they don’t look much like anything else.
And if you’re not used to reading them, it might confuse you. You must have an attorney who goes over what they are thorough, what they mean, and what they don’t. For example, one term often used in legal pleadings regarding custody and visitation is that a parent should have reasonable visitation. What does that mean? Reasonable visitation?
So just using that as an example, I will tell you. Reasonable visitation is as it sounds; you must apply it to a set of facts. What is your life, and what in your ex’s life would dictate what is reasonable for your situation? Your job would affect that.
Whether you travel would affect that. How far apart you live from the other parent would affect that. If you’re going to move, the lawyer you’re using should advise you how that will affect what reasonable visitation is because it will look very different if you live five miles from your ex than if you live 500 miles from your ex. All this to say, what’s reasonable heavily depends on the facts.
You should be advised in advance how to bring facts about, if possible, that would be most advantageous to you getting the time you want with your children.
And you should be defended vigorously after the fact, once the circumstances are set or if you just don’t have any control over them, to get the most reasonable visitation for you and your circumstances. It’s not an easy thing to do.
But an experienced lawyer should be able to help you navigate that situation and get reasonable visitation for yourself and not have an unreasonable amount of visitation for the child’s other parent affecting your custody rights.
