Prenups Avoid Confusion in Case of Divorce
Video Transcribed: My name is Jason Lile, and I am an Oklahoma Dads Rights lawyer. And I wanted to talk to you a little bit today about a topic you might hear about on TV or in movies, but you might not know very much about. And specifically, I’m talking about prenuptial agreements, or prenups as they might be called.
Who needs a prenup? Why would you need a prenup? If you have a significant amount of premarital property and are considering getting married. If it is your decision that you do not want this property to be confused with your marital property, let me explain a little bit.
In Oklahoma, everything, everything that is earned by either of you or increases in value while you are married due to your joint industry of any kind, becomes marital property.
If you have a substantial amount of property, it doesn’t have to be… And I don’t mean substantial in any number in mind, just substantial enough that it matters enough to you to take care of it that way.
You want to identify in a prenuptial agreement that says what happens to this property ahead of time.
Identifies that it’s premarital property, identifies that you do not intend to commingle it or put it together with you and your spouse’s property, such that if in the unfortunate event of a divorce or a legal separation, while you were dividing property, it completely passes out that property that you identified in that prenuptial agreement.
And has already determined the outcome for that property beforehand. It protects you if you get divorced from having your premarital property adjudicated as marital property and therefore divided with your spouse.
There are ways to do this the right way and the wrong way. If you tell your future spouse that you want a prenup agreement, it could cause stress.
