Your Living Arrangement Can Affect Your Case
Video Transcribed: Hello, I’m Tulsa Dad’s rights attorney Jason Lile. I wanted to talk to you today about an issue that affects dads or a question that they might have, and that is how do my living accommodations or my living situation potentially affect my custody case?
A good dad’s rights attorney or someone who is used to counseling men in divorce and family law cases should be able to counsel you on the fact that when you go to court when you negotiate over custody arrangements when you have to present yourself to either DHS or the court or an opposing counsel for consideration of settlement, you want to make sure that your life is in order.
You want to make sure that you are able to ably explain who lives in your home, so you should get some advice on that, where you live, what the conditions are there.
Worst case scenario of DHS, you have to do a home visit. Is it going to pass, and the lawyers should know how to counsel you on that. Also, make sure that you have arrangements for the child or the children to sleep, eat, and play there.
Now, that does not mean if you don’t have the means to have a bedroom for each of your children that you’re going to lose your case, but it does mean that it should be considered and discussed and prepared for so that when you and your attorney go into court, you are able to present a very strong case that it is in your children’s best interest to be able to spend whatever time you’re pursuing with them in court.
That can be as simple as saying, “This is how my household changes when they are there. This bedroom is used by someone when they’re not there, but it’s used by them when they are there. This is how my children will be cared for. These are the people in my home.”
Obviously, you want to make sure they don’t have criminal records or they do not have active drug habits or things of that nature. And so, one of the considerations that a good lawyer, who’s representing you as a man in court in a family law case, should go over is your living arrangements.
