The Answer Is Maybe
Video Transcribed: Hi, I’m a fathers’ rights lawyer in Tulsa. And I’m here talking about fatherhood and fathers’ rights. We get a lot of questions here about fathers’ rights. One of them, if I’m an unwed father, do I have visitation rights in Oklahoma?
The answer is maybe. If you’ve gone to a district court and established that you are the father, and received physical custody rights, then you absolutely have visitation rights that can be enforced by a motion to enforce and/or an application for a contempt citation.
However, if you’re an unwed father, and you have not gone to the district court, and established your parental rights, then you are subject to the whim of the mother. And that doesn’t mean that you shouldn’t ask for visitation rights from her directly during the pendency of trying to establish your rights.
But it does mean that you don’t have the ability to enforce visitation rights until you’ve established them in a district court. So dads, if you are concerned that you’re not getting visitation with your child born out of wedlock, you need to give us a call.
