Video Transcribed: Hi, I’m a child support attorney for men. I’m here talking about fatherhood and fathers’ rights. We get a lot of questions here about fathers’ rights, one of them being can fathers apply for child support. And the answer is yes.
However, fathers would have to have significant custodial rights and physical custody rights, which would provide them the opportunity to apply for child support. If you have a child born out of wedlock and you have not gone to a district court to establish your rights and establish your physical custody rights, then it’d be very difficult for you to acquire child support.
In other words, unless a court says you’re the dad and gives you physical custody rights, that is overnight visitation for a period of more than 121 days, it’s likely that you would not receive child support unless she was making tons of money.
On the other hand, if you do go to court, establish your custodial rights, and receive physical custody of that child, whether it be 121 days or exceeding 182 and a half, it is possible that you would be eligible for child support, depending on your two person’s income. And it’ll involve a calculation that considers both your income levels and both your levels of physical custody, which is overnight visitation.
