Unmarried Fathers Have No Physical Custody Rights
Video Transcribed: I’m the Tulsa Child Custody Attorney for Men. Today I want to talk a little bit about physical custody rights. That is visitation rights. Unmarried fathers have no physical custody rights.
That is they have no visitation rights to their children unless a court has deemed them the father and afforded them visitation rights. What that means is you have no right to compel the mother to give you physical custody or visitation with that child until you establish your parentage in a district court and establish physical custody and/or visitation rights to that child.
Now, visitation rights and physical custody are generally spelled out pretty specifically in court orders, which means that fighting for those physical custody rights and visitation rights in court is important because you want to get as much as you possibly can.
