Consult a Fathers Rights Attorney When Needed
Video Transcribed: I am a Tulsa father’s rights attorney. Let’s talk about attorneys’ representation and civil contempt. First, I want to talk about not the exposure of attorney fees, but your right to counsel, and What that means in terms of getting a lawyer.
If you have a risk of incarceration, which if you are on the child support contempt docket, you do. This statute would apply to you if you’re indigent. Title 12, Chapter Two, is an appendix for rules, this is the Supreme Court of Oklahoma, basically giving out rules for the district courts.
In a civil contempt action, which may result in incarceration of the defendant, who appears without counsel, courts have to inform him that there’s a right to counsel and that if he’s unable to get one, and desires one, that the court will assign one to the defendant.
You can’t actually, intelligently and knowingly, waive or enter a plea without having received this. That is a specific direction from the Supreme Court. While this is actually violative of some tenants of American law because it appears to be providing a decision before a decision is actually… Before the question is before them, it’s called an advisory opinion.
In effect, it operates as a statute and it has been codified in Title 12. A defendant who desires counsel can establish this indigency through normal standards just like one would for any other criminal proceeding.
