We filed a motion to dismiss for failure to prosecute based on your constitutional right to a speedy trial. Well, what is your constitutional right to a speedy trial? It is presumed that after a year, you may be prejudiced in your case. Well, what is prejudice?
Prejudice could be in the form of witnesses inability to recall events accurately, or in a deterioration of the state’s evidence. So it’s very important to contact a lawyer if the state files charges against you. And if it’s been over a year, you should consider talking about your right to a speedy trial.
